violation is a misdemeanor punishable by a fine of not less than $750.00;
provides an exception for noise resulting from necessary repair work approved

employees.

TITLE OF BILL : An act to amend the public health law, in relation
to penalizing noisome activities in residential areas
PURPOSE OR GENERAL IDEA OF BILL : To punish any person who
establishes, maintains or carries on, or permits to be established,
maintained or carried on, in any residentially zoned district, any
activity which, by virtue of its noisome quality, is detrimental to
public health or to the natural environment of such residential
district.
SUMMARY OF SPECIFIC PROVISIONS : Amendment of the public health law
by adding a new section 1300-d of Section 1.
JUSTIFICATION : To consciously promote the health of the inhabitants
in active residential districts.

FISCAL IMPLICATIONS : To be determined
EFFECTIVE DATE : This act shall take effect on the one hundred
eightieth day after it shall have become a law; provided, however,
that the commissioner of health, in consultation with the commissioner
of environmental conservation, is authorized and directed to
promulgate any and all rules and regulations and take any other
measures necessary to implement this act on its effective date on or
before such a date. |
